The Department of Health (DOH) issues Administrative Order (AO) No. 2024-0008 providing the guidelines on the regulation of establishments engaged in the refilling activity of certain cosmetics and HUHS products under the jurisdiction of the Center for Cosmetics and Household/Urban Hazardous Substances Regulation and Research (CCHUHSRR) of the Food and Drug Administration (FDA).

These guidelines answer the call to mainstream refilling stations for certain cosmetic and HUHS products as a means to contribute in addressing environmental issues caused by single-use plastic. It also aims for refilling activities, including the production and distribution of refilled cosmetic and HUHS products, to comply with the regulatory standards set forth by the FDA which ultimately aims to ensure the safety of consumers.

Pursuant to A.O. No. 2024-0008, only FDA-licensed establishments and their refilling stations shall be allowed to engage in the refilling activity of cosmetic and/or HUHS products. Such establishments shall be responsible for ensuring compliance with good practices quality guidelines in the manufacture and distribution of refilled products. Establishments are likewise called upon to ensure that refilled products bear the required labeling information, for the purpose of reasonably informing the consumers of the contents of the product, and to further coordinate with the FDA on any post-marking issue, among others.

The FDA will further issue its implementing rules and guidelines and conduct a pilot implementation of not more than six (6) months, preliminarily covering local Manufacturers engaged in refilling activities of Cosmetic and HUHS products. Affected stakeholders shall likewise be provided with a six (6) -month transitory period for compliance from the effectivity of the implementing rules and guidelines.
